TERMS OF SERVICE

EISHIN AUTO may offer automotive-related services and experiences, including vehicle care and detailing, automotive photography, merchandise, events, enthusiast-community activities, and Paddock membership benefits.

Specific services, pricing, availability, inclusions, and requirements may vary.

Information displayed on our website does not guarantee that a particular service, appointment, event, product, or benefit will always be available.

Appointments may be scheduled through our website using systems provided by Square.

When booking, you agree to provide accurate contact information, vehicle information, appointment information, service-selection information, and payment information where required.

Bookings are subject to availability and confirmation.

We may contact you where reasonably necessary regarding your appointment.

Payments may be processed through Square or another payment provider identified during checkout.

By submitting a payment method, you represent that you are authorized to use that payment method and authorize applicable charges.

EISHIN AUTO does not store full payment-card credentials within its own Supabase database or Slack systems.

You may separately be subject to Square’s terms and privacy practices when using Square services.

Prices shown online may be based on ordinary conditions for the selected service.

A vehicle may require additional labor or services because of factors such as excessive dirt, pet hair, stains, odors, biological contamination, adhesive or residue, paint condition, overspray, unusual contamination, vehicle size, aftermarket equipment, or prior repairs or modifications.

Where practical, EISHIN AUTO will communicate material additional charges before performing substantially expanded work.

Quotes or estimates are not necessarily guaranteed prices unless specifically stated in writing.

Specific cancellation, rescheduling, deposit, or no-show policies displayed during booking are incorporated into these Terms.

You are responsible for reviewing those terms before completing your booking.

EISHIN AUTO may impose reasonable cancellation, deposit-forfeiture, or rescheduling fees where disclosed during booking.

By presenting a vehicle for service, you represent that you own the vehicle or have authority to authorize the service; that EISHIN AUTO has permission to access, move, start, operate, reposition, or otherwise handle the vehicle as reasonably necessary to perform the requested service; and that you have disclosed unusual conditions that could materially affect safe handling or service.

This authorization is limited to actions reasonably related to performing, inspecting, documenting, or delivering the service.

Vehicles naturally contain defects, wear, damage, deterioration, and prior repairs. These may include scratches, rock chips, dents, paint defects, clear-coat failure, cracked trim, loose components, worn seals, wheel damage, interior wear, failing adhesive, delaminating surfaces, mechanical or electrical faults, and previously repaired damage.

EISHIN AUTO may document vehicle condition before, during, or after service.

You agree that EISHIN AUTO is not responsible for pre-existing conditions or for deterioration that becomes apparent during ordinary, professionally performed service where the underlying component was already damaged, defective, weakened, improperly installed, or deteriorated.

This provision does not waive responsibility that cannot legally be waived, including liability arising from conduct for which liability cannot be disclaimed under applicable law.

You are responsible for informing EISHIN AUTO of unusual vehicle characteristics, including aftermarket paint or wraps, ceramic coatings, paint-protection film, custom body components, carbon-fiber components, lowered suspension, modified wheels, racing components, nonstandard electrical systems, custom interiors, and delicate aftermarket parts.

Aftermarket or modified components may react differently to ordinary service procedures.

EISHIN AUTO may decline or modify a service when reasonably necessary to protect the vehicle or our personnel.

Customers should remove valuables and sensitive personal items from vehicles before service.

Except where caused by EISHIN AUTO’s legally actionable conduct, EISHIN AUTO is not responsible for loss of unsecured personal property left inside a vehicle.

Automotive detailing, restoration, correction, cleaning, and appearance services can improve vehicle condition but cannot guarantee that every imperfection can be completely removed.

Results depend on factors including vehicle age, material condition, previous repairs, paint depth, stain penetration, damage severity, chemical exposure, and prior treatments.

EISHIN AUTO does not guarantee “like new” condition unless a specific written guarantee expressly states otherwise.

EISHIN AUTO may photograph vehicles before, during, or after service for condition documentation, quality assurance, operational records, and portfolio purposes.

Use of identifiable customer images or other personal information for marketing remains subject to applicable consent requirements.

Specific events, photography services, promotions, or membership activities may use separate releases.

The EISHIN AUTO Paddock may include membership benefits, community experiences, gatherings, events, access opportunities, promotions, merchandise opportunities, or other benefits described at the time of enrollment.

Paddock benefits may evolve as the program develops.

Unless a specific membership offer expressly guarantees a particular benefit for a defined period, EISHIN AUTO may reasonably modify program benefits, event schedules, or program features.

Additional membership terms may apply and will control where they conflict with these general Terms.

Customers may separately opt in to receive recurring EISHIN AUTO Paddock SMS/MMS communications.

Messages may include meetups, events, merchandise drops, club announcements, membership updates, and promotional communications.

Message frequency varies. Message and data rates may apply.

Consent to receive Paddock marketing texts is not a condition of purchasing goods or services or maintaining membership.

Carriers are not liable for delayed or undelivered messages. Delivery of messages may depend on your carrier, device, service availability, and other systems outside EISHIN AUTO’s control.

You agree not to use the website unlawfully; attempt unauthorized access to our systems; interfere with website functionality; scrape or harvest customer information; introduce malware or malicious code; impersonate another person; use our intellectual property without authorization; or use the website to commit fraud.

We may restrict access where reasonably necessary to protect our systems or users.

Unless otherwise stated, EISHIN AUTO owns or licenses the website content, branding, logos, graphics, photographs, written materials, designs, and other proprietary content associated with EISHIN AUTO.

Nothing in these Terms grants you ownership of EISHIN AUTO intellectual property.

You may not reproduce, sell, modify, distribute, or commercially exploit protected EISHIN AUTO content without authorization.

Merchandise purchases may be subject to separate shipping, return, exchange, pre-order, or final-sale terms shown at checkout.

Product appearance may vary slightly from images because of manufacturing, screens, lighting, or production differences.

Participation in automotive events involves inherent risks.

Certain EISHIN AUTO events may require additional waivers, releases, safety rules, venue terms, or participation agreements. Those event-specific terms will supplement these Terms.

You are responsible for operating your vehicle lawfully and safely at all times.

Nothing communicated by EISHIN AUTO authorizes unsafe or unlawful driving.

EISHIN AUTO relies on third-party services including payment, communications, software, database, hosting, and booking providers.

We are not responsible for independent outages, failures, or conduct of third-party providers that are outside our reasonable control.

Third-party services may be governed by separate terms.

To the fullest extent permitted by applicable law, the website and general informational content are provided on an “as available” basis.

We do not warrant uninterrupted website availability or that every website feature will always operate without error.

Specific automotive services remain subject to any express written warranty or guarantee we separately provide.

Nothing in these Terms eliminates warranties or consumer protections that cannot legally be disclaimed.

To the fullest extent permitted by applicable law, EISHIN AUTO will not be liable for indirect, incidental, special, exemplary, punitive, or consequential damages arising from use of the website or services.

Nothing in these Terms excludes or limits liability where exclusion or limitation is prohibited by law.

Any limitation of liability relating to a specific paid service may also be governed by a separate service agreement signed or accepted in connection with that service.

To the extent permitted by law, you agree to indemnify and hold harmless EISHIN AUTO and its owners, employees, contractors, and representatives from third-party claims arising from your unlawful conduct, your breach of these Terms, your misrepresentation of authority concerning a vehicle, or your violation of another person’s rights.

This section does not require you to indemnify EISHIN AUTO for liability that applicable law prohibits shifting to you.

These Terms are governed by the laws of the State of Colorado, without regard to conflict-of-law principles.

Any dispute not otherwise subject to a separate written dispute-resolution agreement will be handled in an appropriate court having jurisdiction in Colorado, subject to applicable law.

If any provision of these Terms is found unenforceable, the remaining provisions will remain in effect to the extent permitted by law.

Failure by EISHIN AUTO to enforce a provision does not waive the right to enforce that provision later.

We may update these Terms periodically.

Changes become effective when posted unless applicable law requires additional notice or consent.

Your continued use of the website or services after revised Terms become effective constitutes acceptance to the extent permitted by law.
